1. Acceptance of Terms

By accessing and using the Goosed platform ("Service"), operated by Goosed ("Company", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service comply with Irish law and European Union regulations, including the Consumer Rights Act 2022 and EU Digital Services Act.

If you do not agree to these terms, you must not use our Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into binding contracts under Irish law.

2. Service Description

Goosed is a roadside assistance platform that connects customers requiring emergency vehicle assistance with qualified service providers. We act as an intermediary platform and do not directly provide roadside assistance services.

Important Notice:

Service providers on our platform are independent contractors and not employees, agents, or representatives of Goosed.

3. User Accounts

3.1 Registration

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • One person may not maintain multiple accounts

3.2 Account Security

Under GDPR requirements, we implement appropriate technical and organizational measures to ensure account security. You are responsible for all activities that occur under your account.

4. Service Provider Terms

4.1 Provider Requirements

Service providers must:

  • Hold valid Irish business registration and tax compliance certificates
  • Maintain appropriate motor trade insurance as required by Irish law
  • Possess valid driving licenses and vehicle roadworthiness certificates (NCT)
  • Comply with the Safety, Health and Welfare at Work Act 2005
  • Maintain public liability insurance of at least €6.5 million
  • Complete Garda vetting where required

4.2 Service Standards

Providers must adhere to the Service Level Agreement, including response times, professional conduct standards, and quality requirements as set forth in the Provider Agreement.

5. Customer Rights (EU Consumer Protection)

5.1 Statutory Rights

Nothing in these terms affects your statutory rights as a consumer under Irish and EU law, including:

  • Right to receive services with reasonable care and skill
  • Right to accurate service descriptions and transparent pricing
  • Protection under the Consumer Protection Act 2007
  • Rights under the EU Consumer Rights Directive 2011/83/EU

5.2 Cancellation Rights

For pre-booked services, you have the right to cancel within 14 days of booking without giving any reason (cooling-off period). For immediate emergency services, you waive this right as services commence immediately at your explicit request.

6. Pricing and Payment

6.1 Transparent Pricing

  • All prices displayed include VAT at the current Irish rate (23%)
  • Final price will be confirmed before service commencement
  • Additional charges may apply for specialized equipment or extended distances
  • Platform service fee is clearly disclosed before booking confirmation

6.2 Payment Terms

Payment is processed securely through our payment partners who are PCI-DSS compliant. We accept major credit cards, debit cards, and authorized digital payment methods. Payment is due upon service completion unless otherwise agreed in writing.

6.3 Refunds and Disputes

Refunds are processed in accordance with Irish consumer law. Disputes must be reported within 48 hours of service completion. We participate in the EU Online Dispute Resolution platform.

7. Limitation of Liability

Legal Notice:

The following limitations comply with the Unfair Contract Terms Directive (93/13/EEC) and Irish consumer protection law.

7.1 Platform Liability

To the maximum extent permitted by Irish law, Goosed's liability is limited to the platform service fee paid. We are not liable for:

  • Acts or omissions of independent service providers
  • Indirect, incidental, or consequential damages
  • Loss of profits or business interruption
  • Force majeure events

7.2 Indemnification

Service providers agree to indemnify and hold harmless Goosed from any claims arising from their provision of services, including but not limited to personal injury, property damage, or breach of contract claims.

8. Data Protection (GDPR Compliance)

We process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 and the Data Protection Act 2018 (Ireland). Please refer to our Privacy Policy for detailed information about data processing.

8.1 Key Rights

  • Right to access your personal data
  • Right to rectification of inaccurate data
  • Right to erasure ("right to be forgotten")
  • Right to data portability
  • Right to object to processing
  • Right to lodge a complaint with the Data Protection Commission

9. Intellectual Property

All content on the Goosed platform, including logos, text, graphics, and software, is protected by Irish and EU intellectual property laws. The Goosed trademark is registered in Ireland and the EU.

Users grant Goosed a non-exclusive, worldwide license to use any content submitted through the platform for service provision and platform improvement purposes.

10. Prohibited Uses

Users may not:

  • Violate any Irish or EU laws or regulations
  • Provide false or misleading information
  • Interfere with platform security or operations
  • Engage in fraudulent or deceptive practices
  • Harass, abuse, or discriminate against others
  • Attempt to circumvent the platform for direct dealings
  • Use automated systems or bots without permission
  • Violate the Computer Misuse Act 1990

11. Insurance and Safety

11.1 Provider Insurance Requirements

All service providers must maintain:

  • Motor trade insurance compliant with the Road Traffic Act 1961
  • Public liability insurance (minimum €6.5 million)
  • Employer's liability insurance where applicable

11.2 Safety Compliance

All services must be performed in compliance with Irish road safety laws, Health and Safety Authority guidelines, and industry best practices.

12. Dispute Resolution

12.1 Internal Resolution

We aim to resolve disputes internally within 30 days. Please contact our support team at support@goosed.ie with any concerns.

12.2 Alternative Dispute Resolution

For unresolved disputes, we offer ADR through the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr

12.3 Legal Proceedings

These terms are governed by Irish law. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts, except where EU consumer protection laws provide otherwise.

13. Changes to Terms

We reserve the right to modify these terms with 30 days' notice for material changes. Continued use of the Service after changes constitutes acceptance. Users will be notified via email of any material changes.

14. Termination

Either party may terminate this agreement with 30 days' written notice. Goosed may terminate immediately for breach of terms, fraudulent activity, or legal compliance requirements. Upon termination, outstanding obligations and payments remain due.

16. Severability

If any provision of these terms is found to be unenforceable or invalid under Irish or EU law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.

Advice about your legal rights is available from your local Citizens Information Centre or the Competition and Consumer Protection Commission. These terms do not affect those rights.
